REGULATION (EU) No 305/2011 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC

2011年3月9日欧洲议会和理事会法规(EU) No 305/2011规定了建筑产品销售的协调条件，并废除了理事会指令89/106/EEC

 

1 Subject matter 主旨

This Regulation lays down conditions for the placing or making available on the market of construction products by establishing harmonised rules on how to express the performance of construction products in relation to their essential characteristics and on the use of CE marking on those products.

该法规订明在市场上投放或提供建筑产品的条件，并就如何就建筑产品的基本特性表达其性能，以及在这些产品上使用CE标志，制订协调规则。

 

2 Definitions 定义

For the purposes of this Regulation the following definitions shall apply:

‘construction product’ means any product or kit which is produced and placed on the market for incorporation in a permanent manner in construction works or parts thereof and the performance of which has an effect on the performance of the construction works with respect to the basic requirements for construction works;

“建筑产品”是指任何产品或组件，以生产和永久的方式投放市场，就建筑工程的基本要求而言，其绩效对建筑工程的绩效有影响的;

 

3 Basic requirements for construction works and essential characteristics of construction products建筑工程的基本要求和建筑产品的基本特征

The basic requirements for construction works set out in Annex I shall constitute the basis for the preparation of standardisation mandates and harmonised technical specifications.

附录I所列建筑工程的基本要求，是编制标准化指令和统一技术规格的基础。

The essential characteristics of construction products shall be laid down in harmonised technical specifications in relation to the basic requirements for construction works.

建筑产品的基本特性须在与建筑工程的基本要求有关的协调技术规范中订明。

 

4 Declaration of performance DOP性能声明

When a construction product is covered by a harmonised standard or conforms to a European Technical Assessment which has been issued for it, the manufacturer shall draw up a declaration of performance when such a product is placed on the market.

当建筑产品被协调标准覆盖或符合欧洲为其颁发的技术评估时，制造商应在该产品投放市场时起草一份性能声明。

5 Authorised representatives 授权代表

A manufacturer may appoint, by written mandate, an authorised representative.

制造商可以通过书面授权委任一名授权代表。

The drawing up of technical documentation shall not form part of the authorised representative’s mandate.

编制技术文件不属于授权代表的职权范围。

 

6. CPR 法规对于建材产品的 7 项基本性能要求：

1）. 机械阻力及稳定性（Mechanical resistance and stability）

建筑工程的设计和施工必须使其在施工和使用过程中可能承受的载荷不会导致下列事故的 发生：

a. 工程整体或部分倒塌；

b. 变形严重到不允许的程度；

c. 承载结构严重变形，引起工程其他部分或装置或安装的设备遭到损坏；

d. 事故造成的损坏与初衷不相称。

2）. 防火安全(Safety in case of fire)

建筑工程的设计和施工必须在突发火灾时：

a. 使结构承载能力维持一段特定的时间；

b. 使工程范围内火、烟的产生与蔓延受到限制；

c. 使火势向临近建筑工程的蔓延受到限制；

d. 使人员能逃离该工程或以其他方式得到营救；

e. 使救援人员的安全得到考虑。

3）. 卫生、健康与环境(Hygiene, health and the environment)

建筑工程的设计和施工必须保证其不对工程范围内的人员或邻里的卫生和健康构成威胁，尤 其不能发生下列情况：

a. 释放有毒气体；

b. 空气中出现有害微粒或气体；

c. 释放有害辐射；

d. 对土壤或水造成污染和毒化；

e. 对废水、烟、废物或废液清除不当；

f. 工程各部分或其内表面出现潮湿

4）. 使用安全和方便(Safety and accessibility in use)

建筑工程的设计和施工不得造成操作或使用过程中出现诸如滑移、跌落、碰撞、烧伤、触电、 爆炸受伤等不能接受的事故危险。

5）. 噪音防护(Protection against noise)

建筑工程的设计和施工必须使工程范围内的人员及附近居民能觉察出来的噪音控制在低水 平，使他们的健康不受威胁并能让他们在令人满意的环境中睡眠、休息及工作。

6）. 节能及保温(Energy economy and heat retention)

根据当地气候条件及人员情况，建筑工程及其供暖、制冷、通风装置必须在设计和施工上保 证使用尽可能少的所需能量。

7）. 自然资源可持续利用(Sustainable use of natural resources)（CPR 法规新增加）

对于自然资源的利用更合理，符合可持续发展的要求。
